EVALUASI KEBIJAKAN PENEGAKAN HUKUM KEJAHATAN KONVENSIONAL DI POLRES BANJAR POLDA KALIMANTAN SELATAN
Abstrak
Globalisasi memicu adanya perubahan perilaku kehidupan masyarakat, Perubahan ini menyertakan pola-pola kejahatan yang bergeser dari pola-pola kejahatan statis tradisional ke pola-pola kejahatan yang dinamis modern salah satunya kejahatan konvensional yang marak terjadi di Indonesia, termasuk wilayah Banjar. Tujuan dari penelitian ini untuk mengetahui latar kebutuhan, perencanaan, implementasi, dan hasil yang dicapai dari evaluasi kebijakan penegakan hukum kejahatan konvensional di POLRES Banjar. Penelitian ini merupakan penelitian kualititatif deskriptif, data bersumber dari data primer dan data sekunder yang dikumpulkan dengan observasi, wawancara dan studi kepustakaan. Teknik analisis yang digunakan mengacu pada UU No 8 tahun 1980 mengenai KUHAP dan Perkap No. 6 tahun 2019 tentang Penyidikan tindak pidana serta menggunakan model Context, Input, Processes dan Product (CIPP). Diperoleh hasil bahwa dalam tahap evaluasi latar kebutuhan (Content) wilayah Kabupaten Banjar dipengaruhioleh kondisi wilayah, kondisi masyarakat, tingkat kepadatan penduduk, tingkat pendidikan dan tingkat pendapatan masyarakat, pada tahap evaluasi perencanaan POLRES Banjar, masih kurang memadai karna keterbatasan seperti jumlah personel, aspek kompetensi dll. Pada tahap evaluasi implementasi terdapat faktor yang dinilai kurang optimal. Dan pada tahap evaluasi hasil capaian Output yang dicapai yaitu terwujudnya kesiapan Polres Banjar dalam melaksanakan penegakan hukum kejahatan konvesional, terwujudnya kepastian hukum, terwujudnya rasa keadilan dan terwujudnya kepercayaan masyarakat.
Globalization triggers changes in the behavior of people's lives. This change includes crime patterns that shift from traditional static crime patterns to modern dynamic crime patterns, one of which is conventional crime that is rife in Indonesia, including the Banjar area. The purpose of this study was to determine the background of the needs, planning, implementation, and results achieved from the evaluation of conventional crime law enforcement policies at the Banjar POLRES. This research is a descriptive qualitative research, data sourced from primary data and secondary data collected by observation, interviews and literature study. The analytical technique used refers to Law No. 8 of 1980 concerning the Criminal Procedure Code and Perkap No. 6 of 2019 concerning the investigation of criminal acts and using the Context, Input, Processes and Product (CIPP) model. The results showed that in the evaluation stage the background needs (Content) of the Banjar Regency area was influenced by regional conditions, community conditions, population density levels, education levels and community income levels. etc. At the implementation evaluation stage there are factors that are considered less than optimal. And at the evaluation stage of the results, the output achieved is the realization of the readiness of the Banjar Police in carrying out conventional crime law enforcement, the realization of legal certainty, the realization of a sense of justice and the realization of public trust.
